ABSTRACT

In the modern aging society, the role of nurses is increasing as the demand for nursing services increases. The Medical Service Act defines nurses as medical personnel. However, the specific scope of the work is not directly defined. The work of nurses can be divided into unique nursing work and work that assists doctors in medical treatment. And there is a overlap between this work. In particular, when assisting the doctor's treatment according to the doctor's order or delegation, there is no specific content or standard to distinguish between medical practices that only doctors can do and those that assist the treatment. For this reason, it is not possible to clearly judge the nurse's professional negligence responsibility. Along with the issue of enacting the Nurses Act, which is actively discussed these days, the mission of medical personnel must be prioritized in order to provide high-quality medical services to medical consumers. A reasonable standard should be established to seek a horizontal division of labor relations between doctors and nurses.
