ABSTRACT

Due to the development of the 4th industrial revolution and the impact of COVID-19, our lives and values ​​are also changing significantly. In particular, the recent environmental problems and the depletion of resources are constantly raising concerns in countries around the world. In preparation for this, many experts are having various discussions, and one of the solutions to this is the sharing economy.The sharing economy is characterized by the ability to save resources as much as possible by effectively using limited resources with many people. Also, if we get used to the sharing economy, our lives can become much more convenient than now. However, awareness of the sharing economy has not yet been properly established in our society, and institutional aspects and legal systems are also incomplete. Meanwhile, countries around the world, including the United States, are already practicing the sharing economy with global companies as leaders. On the other hand, there is a lack of discussion and related research in Korea, so I would like to assert the necessity and urgency of research on this in preparation for the upcoming sharing economy era. To this end, it is necessary to clearly define the main contracting parties of the sharing economy. Representatives are online platform operators, consumers, and online platform users. In addition, the responsibilities, such as rights and obligations, must be clearly defined. Meanwhile, it is expected that the sector in which the sharing economy will spread the fastest in Korea is the ride sharing sector. Of course, ride sharing has already been implemented in Korea, but many challenges remain. When the sharing economy is activated in earnest in the future, specialized companies will enter the market. In particular, it is highly likely that the sharing economy will be revitalized with the era of self-driving cars, which are about to be commercialized sooner or later. Therefore, in order to prepare for this period, it is seen that legislation and government policies are urgently needed to resolve legal disputes in the event of an accident of an autonomous vehicle. Of course, legal disputes caused by accidents of self-driving cars will basically have to be resolved through auto insurance. However, self-driving cars can drive through an artificial intelligence system, so there is a limit to their application with simple conventional auto insurance. Therefore, it is time to urgently fix the application of self-driving car insurance in line with the upcoming sharing economy, and to expand and apply it to the sharing economy platform market.
