ABSTRACT

In most countries, restorative justice programs apply primarily to non-hazardous cases, relatively minor crimes such as property crimes and petty violent crimes, and are cautious about serious crimes. However, the more severe the crime, the greater the need for recovery of the victim's material and mental damage, so restorative intervention becomes more important. Indeed, in countries such as Canada, Belgium and France, restorative justice programs such as post-sentence restorative meetings and support and accountability circles are applied even to serious crimes such as sexual assault and murder. In this study, institutional, legislative, and practical measures are proposed to apply restorative justice programs or systems to serious crimes such as sex crimes and murder in Korea, and ultimately, restorative justice expands its existing criminal justice system. We tried to suggest a way to fully integrate and develop.
