ABSTRACT

In recent years, heightened public concern regarding juvenile crime has underscored the need to move beyond traditional punitive approaches and toward policy responses that reflect the structural causes of delinquency and its developmental context. This study examines the evolution of Japan’s Juvenile Law and recent trends in juvenile delinquency, with a particular focus on the findings of the 2023 special survey conducted by Japan’s Ministry of Justice titled “Delinquent Youth and Nurturing Environment.” The survey, the first government-led empirical study in Japan to statistically establish the correlation between youth delinquency and childhood trauma, offers valuable insight into the role of Adverse Childhood Experiences (ACE) in shaping juvenile offending. It represents a significant step toward incorporating Trauma-Informed Care (TIC) principles into juvenile justice policy. Drawing on these findings, this study analyzes Japan’s legislative and policy developments and discusses the necessity of institutionalizing ACE assessment and TIC-based interventions within South Korea’s juvenile justice system. Emphasizing a paradigm shift from punitive measures to restorative justice and prevention-oriented policy, this study contributes to the global discourse by providing empirically grounded policy implications for future juvenile justice reforms.
