ABSTRACT

With the discussion on prosecutorial reform by the new government, concerns over the Police power expansion has been raised again, and then arguments for enhancing the Autonomos Police system and for organizational separation between administrative police and judicial police has been argued. Current Autonomous Police system in operation faces criticism as being only nominally autonomous, and there are also concerns that the lack of legal barriers to prevent administrative police from intervening in investigative functions could undermine the independence and fairness of Police investigations. Therefore, this study reviews the meaning of decentralization and the problematic issues triggered by organizational separation. To do so, it analyzes the Mexican policing system and security situation, which fully separates administrative and judicial police within a decentralized police structure, and tried to draw implications for Korean Police. The findings suggest that the Metropolitan autonomous police should be a centre of the Police system where National Police should concentrate on securing specialized capacity for nationwide crimes blocking and anti-terrorism, requiring a unified national response. Meanwhile, it is effective to maintain functional separation between administrative and judicial police, with strengthening the independence and fairness through democratic control measures.
