ABSTRACT

This article is intended to provide the assessment on revised Draft of Electronic Signature Act(hereinafter ‘Draft’). The Draft covers two areas, which are of the protection of information-telecommunication infrastructure, and of the electronic signatures. While the former is mainly based on the hardware for the protection against the intruder on Internet, the latter has designed not only to facilitate the electronic transactions, but also to cover their concerns of how legally binding the transactions are. These subject-matters are heterogeneous, hard to be tied up titled Act as the current Draft. It is necessary to prescribe the electronic signatures under a newly titled Combined Electronic Signature Act which have realm extended the private to the public, that is, it is to get together the electronic signature under the Electronic Signature Act and the electronic seal(or administratively electronic signature) under the Electronic Government Act. And with respect to the relationship between electronic signature and electronic seal under a newly titled Combined Electronic Signature Act, this article recommends that the other two signatures keep up with each its own system based on Public Key Infrastructure(PKI) until two systems can work the compatibility perfectly.
