ABSTRACT

Written judgments from the Joseon Dynasty are very useful resources for understanding the full accounts of events in that they thoroughly record the process of litigation. Tracing the litigation process through the written judgment, it can be observed that the basis of an argument from either side of the plaintiff or the defendant sometimes weakens. In other times, efforts to lead the litigation in one’s favorable way by often turning over the previous arguments or submitting other evidence can be seen. The written judgment from the time thus becomes an valuable resource. This paper attempts to shed light on the fact that the slaves were also a main body that actively used the laws and customs at the time for the purpose of leading a safer life, by examining the voice of a female that is contained in a litigation document from the 16th century.
