ABSTRACT

This article is to seek the concept of broadcast, communications, and the convergence and observe the basic principles which should be covered to regulate the convergence and analyze concrete cases of new media such as IPTV and DMB. Consequently it should be noted that concrete regulation about convergence should be set up in order to be complete in principle of the social nation and the cultural nation. When the convergence is regulated under the constitutional principle, it should be referenced to public interest and universal service as a concrete rationale. In principle, it is appropriate that special act on convergence of broadcast and communications should be set up and regulated and recognized as a third type, not any more traditional broadcast and communications. If it is difficult in short time, the current broadcast act should be amended to broaden the boundary of broadcast alternately. In conclusion, the speed governing broadcast and communications is very high so that the regulation should be flexible to cover it.
