AB - In this Article, we will explore how governments can best achieve a legislation system to manage efficiency the government R&D performance. In order to examine the legal system of the government R&D, it is essential to understand the current acts and guidelines of management system for the government performance. Science and Technology are advancing at an increasingly rapid pace and the ways in which they interacts with the economy, society and the environment is becoming increasingly complex. We have a basic act about government performance of science and technology management and many subordinate statutes. It is 'Fundamental Act of Science and Technology', 'Provision on Management of National R&D Permance(enforcement decree)' and 'Enforcement Rule on Management of National R&D Performance'. These act and provisions are to unite the government management of national R&D. However we have had many regal problem, because each competent administrative agency of national R&D have each provision of the management performance about national R&D.The goals of this study are to analyze the problems of the current rules and to propose the improvement of the legislation system to manage the government R&D performance.
