ABSTRACT

Korea Land Corporation and Korea National Housing Corporation are public enterprises. A public enterprise is an enterprise managed directly by the national or local governments or their corporations for social public welfare. A public enterprise also has a characteristic of private enterprise in that it is an enterprise operated under the direct or indirect participation of national governments or others, but means a business managed for social public welfare, i.e., a business to provide goods or services needed for the life of people or residents. Korea Land Corporation aims to “contribute to the healthy development of national economy by accelerating the efficient use of land resources and promoting the synthetic use and development of national land through the acquisition, management, development and supply of land(Korea Land Corporation act, article 1).” Korea National Hosing Corporation aims to “contribute to the stabilization of people's life and enhancement of public welfare through the construction, supply and management of housing and improvement of inferior housing(Korea National Housing Corporation act, article 1).” Compared with Smend's consolidation process theory, the consolidation of public enterprises should be promoted in an ultimately personal, functional and material consolidation's point of view in order to realize its completion. There should be a legal review in the end in such consolidation. This is just the request from a principle of the rule of law and constitutional state
