ABSTRACT

In today an information oriented society, an individual, who has been the subjects of information, is gradually degraded to the objects of information. Under this risky circumstance, the right to self-determination of private information is very important the basic rights. Because this right protects a person's the freedom and secret of privacy. Therefore, this right is based on Article 17 of the Constitution in that it allows an individual to manage his/her private information. Meanwhile, the current resident registration number exposes various types of personal information of the holders through the number itself and cannot be changed throughout one's life. In this respect it violates Übermaßverbot and infringes on the right to self-determination of private information. Also, a administration legislation about a matter of resident registration number from the viewpoint of the resident registration law violates the doctrine of parliamentary saving. Therefore, hereafter korea's resident registration number shall be changed random serial numbers and resident registration number system allow an individual to change his/her resident registration number as desired.
