ABSTRACT

The purpose of land planning and using act is to achieve environmentally-friendly and sustainable development through effective use and conservation of natural environment. One of the concrete ways to obtain the objective is to improve quality of life through a housing project and private participation should be assured in the process. Private participation is a column that holds the basic principles of land planning and using, which comprise publicity, harmony of public interest and private interest, conflict solution ,and compensation. And there are several ways of private participation such as hearings on the comments of residents, private and public hearings, permission of development act, and participation in the urban planning committee. To activate private participation, the private sector should be given initiatives to plan land using, and governments should simplify the procedures of land development, and they should supply land needed for development by the private sector. In addition the private sector should be endowed with eminent domain power with limitations ,and finally the participants who have taken part in the procedures of land planning and using should be accordingly rewarded.
