ABSTRACT

Korean Government enacted Basic Act on Low Carbon Green Growth to foster green industries as a new motive power through a virtuous circle structure between economy and environment, while it would contribute to the international efforts to cope with climate change and the Act became effective on Apr 14 2010. In this article, I rearranged the issues of several public hearings and opinions of each field including environmental groups during the legislative process of this act and examined problems of the legislative process of this act. Furthermore I suggested that the evaluation of legislation should be fully exploited to give justification and to settle and integrate conflicts of peoplein societies. In this article, I examined relations between it and Sustainable Development Act, economic laws, environmental laws and any other law and analyzed its major contents while I found its legal character. Under the Basic act, I found the function and role of the Committee on Green Growth and suggested that it would be changed into an administrative commission to carry out green growth policies effectively.
