ABSTRACT

This study aimed to examine the arguable problems and legal issues which variation of land parcel area may occur in carrying out cadastral resurvey project. In order to achieve this goal, I intended to investigate legal principles of issues by annotating the existing documents and judicial precedents. Then, I described the core of a topic for discussion in details. After studying, I recognized that a cost compensation system is not suited for the best solution because there is difference between the project and general public works. And also, an adjustment system of differences which is usually used in urban development or renewal works does not exactly fit the case. In addition, a reconciliation method among land owners will cause some burden such as time or financial problems because of conflicting interests. Therefore, this study proposed that the government should firstly make an allowance for the reason why the cadastral disagreement has happened prior to adopting the specific methodology. And then, it must take the most effective measures available by providing the multilateral solutions which is mixed above alternatives. Furthermore, this study urged the need of legal improvement for success of the project.
