ABSTRACT

High-depth underground is being defined as the depth in which normal utilization of land owner is not expected and considered as not disrupting ordinary land usage. In the case of range of High-depth underground in which private ownership takes effect, it requires a procedure of acquisition upon discussion or acceptance to use High-depth underground land for public purposes as in the case of above ground land. However, it is much more complicated to determined the amount and scope of High-depth underground acceptance and compensation compared to the procedure of using above ground land. In such case, it would be able to easily use High-depth underground space without experiencing various issues mentioned above by considering High-depth underground as where private ownership, namely private usage right does not take effect. The main purpose of this study is to analyze the main contents of "Special Act on High-depth Underground Usage" of Japan that allows High-depth underground usage without compensation when used for public purposes to obtain the implications on the possibility of its application in our country.
