ABSTRACT

This study is the main purpose to the change of land legislation in the North Korea and review of legal issues of land consolidation at the time of the unification of North and South Korea. The government of North Korea has developed special economic zones based on the China's opening policy and reform experience. Depending on the development of special economic zones, the North Korea is appearing to changes in land system. Partially, system of private ownership of land is being resurrected in North Korea. Especially, free economic trade zone designation and land lease legislation, and legal framework for the establishment of special economic zones influenced by the open-door policy in China, it should be noted that we are North Korea's policies. Point of view on the unification and integration of North and South Korea, it is very important that how will you set on the system of land ownership. In this paper, I examined the North Korean system of land reform and land ownership for the foundation of the politics of North Korea. In this paper, I have studied on the direction and integration issues for the land system of the North and South Korea at the time of unification. Specifically, the open-door policy with North Korea, the resurrection of the private property system, the design and development of a special economic zone in North Korea, China's economic zone model and legislation for land. About legislation for the land of North and South Korea, I studied on the possibility of its application for one country and two systems. A condition that Korea should be system of private property, after the reunification, Korea should be on the basis of the legal institution for one country and two systems. Also, direction with respect to the base of the land system of unified Korea, we will need to review the experience of China's land system operation. In this paper, we examined the applicability about the long-term land lease system, shared system of land, and land use rights. Unified Korea should be prepared about the following issues. First, how will really change on the land system for the development of rural and urban of North Korea. Second, what will solve the problem of labor supply on essential condition for the development of a special economic zone in North Korea. And third, how reliable do need to settle model of special economic zones and economic zones in China and North Korea. Why is important to note that upon the land system, it is a source of state power. At the same time issues to the surrounding land system are directly linked economic integration, unification costs, migration, infrastructure, economic development of North and South Korea. The integration of land legislation of North and South Korea will be built on a realistic basis. Therefore we are interested to have a land for the establishment of institutions for future-oriented. In the end, it will reduce the Unification costs of North and South Korea.
