ABSTRACT

The conception of Justice and equity developed by the well-fare state in the 1960s was founded on Rawl's theory of justice. Justice and equity have been accepted since as an ideal of judicial science. This study was planned considering that the primary theoretical task for deepening and extending the ideal of justice and equity is to formulate a conceptual structure of them. This operations-categorization, proportion, comparison-interact in each principle. Another principal questions of utilitarianism(common good) to be dealt with in this paper are of whether the desire fulfillment or preference satisfaction account can really be free from the criticisms about the mental state account, and of how this desire account can be accommodate such values essential to human well being as autunomy and personal liberty. Theoretically, the conceptual structure of justice, equity and common good can be utilized to analyze, compare, criticize, evaluate various principles of justice, equity and well-being. Practically, it can show the national assembly, public administration and judiciary how to deliberate to make just policies in the world.
