ABSTRACT

Land can be used for various public interest and tool to solve various environmental problems, especially in the perspective of environmental law. This is especially true in carbon dioxide emissions, in response to the international regulation. In the meaning of this, carbon dioxide underground storage facilities are spot lighted as carbon dioxide reduction facilities which are also the premises of use of land. This environmentally friendly use value of land, eventually can bring about bigger conflicts between the users of land in connection with limitedness of land. In that sense, the Germans see use of land on carbon dioxide underground storage competitive and vertical use of land use. In this paper, we looked into an overview of legal attitude on this Germany's hierarchical and competitive underground use of land and German Act on carbon dioxide underground storage. We also introduced German residents' opposition cases to CO2 storage facility and suggested some legislative standards to public acceptance for CO2 storage facilities and technology in Korea.
