ABSTRACT

Firefighters take great risks of rescuing people from fire and on the science of accidents. In addition, they engage in preventing various disasters from occurring in advance so that they can reduce victims from calamities. However, the current law [Fundamental Law of Firefighting] only stipulates basic articles of firefighting and its operation. It means that the law does not cover fundamental operation of firefighting in detail so it is difficult to clarify the operation. Thus, it is necessary to establish a law regulating general authority, which is given to firefighters and their operation so that firefighters should get a legal ground for their works and professionalism. Besides, firefighters occasionally have a car accident on the way to sites. In that case, they do not usually get proper compensation for the accident from the government. To make it worse, fifefighters frequently make the compensation from their pockets for the damage and victims that take place during their operation. Hence, it is essential to handle with this problem. The government should compensate the damages and victims on behalf of firefighters on their duty. In order for firefighters to save people and protect facilities from catastrophes by swiftly arriving to sites, it is needed to build a law, which specifically states law enforcement of firefighters as well as to come up with a plan to compensate for the victims and damages that are caused by firefighters during their operation. Therefore, this study analyzes the problem of law enforcement concerning the authority of firefighters' operation and suggests its remedial measures.
