ABSTRACT

With the evolution of artificial intelligence (AI), production will explode in the future, and how to distribute it is an important social agenda. In addition, legal issues related to artificial intelligence (AI) are emerging in law. Are the artificial intelligence (AI) as the object of the norm as the development of science and technology, and will the extent of subject in the current normative system be extended to artificial intelligence (AI)? If this is the case, the legal approach to AI responsibility and liability to those who use AI should be considered first. Because the voluntary actions of those who own and use AI have an impact on humans as well as the world, the legal action against them is the subject of future discussions. In this Study, we discuss the issues related to artificial intelligence (AI), especially in the field of intellectual property, which is a combination of artificial intelligence (AI) and robots. First, we analyze the current technology of artificial intelligence (AI) and discussion on behavior subjectivity. Through this, we will examine the improvement of the normative system according to the current technological power and the degree of technological development of AI in the future. Two, Analyze the discussion of legal acts of AI. Specifically, it examines the issue of responsibility for whether to view the behavior of robot with AI (artificial intelligence) as an agent or as a tool. Finally, I would like to present the problem and improvement plan through the analysis of various legal issues related to intellectual property rights created by the activities of artificial intelligence (AI) through ① analysis of intellectual property rights in the Constitution, ② patent rights, ③ copyrights. In this study, rather than simply enacting and revising laws, research on the criteria of artificial intelligence (AI) should reflect all opinions of related fields such as scientists, ethics scholars, psychologists, lawyers, doctors, religious scholars, educators will be. In Korea, if a robot that is applied artificial intelligence has influence on social norms and a ministry dedicated to appropriate regulation and policy is selected, it is necessary to discuss whether a ministry is appropriate or an independent intellectual property committee composed of experts is appropriate.
