ABSTRACT

Surrounded by the sea on three sides, the Republic of Korea is a country that must deal with various incidents and accidents occurring at sea. As a result, the national police is not a single system, but is operated in a dual system of the Coast Guard and the Land Police. However, due to the limitations of the budget and support for the maritime sector, the Coast Guard is short of personnel, and we propose the need for specialized maritime investigators who can serve as supplementary personnel with expertise. According to the statistical data of the Korea Coast Guard in 2023, more than 47,000 maritime-related incidents, accidents, and violations occurred, of which 3,500 were maritime criminal offenses and 44,000 were maritime special law crimes. The Certified Detective Act currently under discussion in the National Assembly excludes the qualifications, functions, and roles of maritime investigators who specialize in investigating maritime accidents and maritime illegal acts. In order to supplement and support maritime police activities, it is judged necessary to establish an institutional system for maritime investigators who specialize in this field. Based on the current problems and necessity due to the absence of the relevant system and the analysis of specialized detective systems in the maritime field operating overseas, the model, role, and utilization plan of a specialized detective system in the maritime field suitable for Korea were presented.
