ABSTRACT

Spain is recognized for having one of the most legally and institutionally developed private investigation systems in Europe. This study aims to examine the legal structure and operational practices of the Spanish private detective system and to compare them with those of South Korea in order to identify key differences and implications. Focusing on Spain’s Private Security Law(Ley 5/2014), the research analyzes the legal status, qualification requirements, training systems, scope of duties, and ethical standards for private detectives. These aspects are compared with the current legal debates and the reality of private investigation-related professions in Korea, which still lack a formal legal framework. Additionally, the study examines similarities and contrasts in actual practices, public-private cooperation, social perceptions, and roles within the private security industry in both countries. The findings show that while Spain maintains a balance between regulation and professional autonomy, Korea remains in a transitional phase, seeking institutional legitimacy for private investigation services. By conducting a cross-national comparison, this research offers insights into the challenges and opportunities in the development of formal private detective systems and contributes to policy-oriented discussions.
