ABSTRACT

In the 21st century knowledge-based economy, protecting intangible assets like trade secrets has become essential for corporate competitiveness. However, South Korea lacks sufficient civil remedies for trade secret infringement. This study compares trade secret protection laws and the role of private investigators in Japan, the U.S., Germany, and France. Japan revised its Unfair Competition Prevention Act to reduce the burden of proof, while the U.S. enacted laws such as the Economic Espionage Act and the Defend Trade Secrets Act to support prevention and evidence collection. Germany and France allow certified investigators to collaborate with law enforcement and legal professionals. Based on these cases, Korea private investigation could enhance legal protections for SMEs and strengthen the national framework for trade secret enforcement. Further research is needed to explore this connection.
