ABSTRACT

This study examines the civil law nature of detective service contracts and the contractual obligations arising therefrom, with the aim of proposing normative standards to prevent contractual disputes. In Korea, detective services operate largely through private contracts in the absence of formal legislation, resulting in persistent legal uncertainty regarding the nature of contracts and the allocation of rights and obligations. This study analyzes detective service contracts primarily under the mandate provisions of the Korean Civil Act (Articles 680–692). The analysis shows that detective service contracts are not contracts for work guaranteeing specific results, but mandate-based contracts that emphasize the process of performing entrusted affairs with the duty of care of a prudent manager, while incorporating mixed and atypical elements. The study further identifies the need to clarify the purpose and scope of entrusted affairs, contractual duties, remuneration, and termination standards through standardized contracts, which may serve as an important foundation for future institutionalization of the detective industry.
