ABSTRACT

This study analyzes the legal risks and institutional limitations faced by digital private investigation activities utilizing Open Source Intelligence (OSINT), and proposes a compliance framework to address these challenges. In recent years, the private investigation industry has shifted toward data-driven digital practices, increasing conflicts with existing legal frameworks, particularly the Personal Information Protection Act. This has resulted in various legal and ethical issues related to collecting publicly available information, combining datasets, and re-identifying individuals. Accordingly, this study identifies key legal issues through the analysis of statutory provisions and judicial precedents, as well as a comparative examination of regulatory systems in advanced jurisdictions. Based on these findings, it proposes practical guidelines for information collection and a compliance model centered on internal control mechanisms. The results indicate that the grounds for precluding illegality in private investigative activities are narrowly recognized under the current legal framework, exposing practitioners to significant judicial risks. Therefore, establishing clear legal standards and an effective compliance system is essential for the sustainable development of the private investigation industry.
