ABSTRACT

This study examines the private investigation system of Singapore from the perspective of security governance and compares it with the current Korean context in order to suggest an institutional direction for Korea. Using a comparative legal approach and institutional analysis, the study reviews Singapore’s relevant laws and administrative materials as well as Korean general laws and legislative bills. The findings indicate that Singapore operates a police-supervised ex ante control model that incorporates private investigators into the private security regulatory framework through dual licensing of agencies and individuals, employment reporting, maintenance of staff registers, identity verification, equipment control, confidentiality obligations, and criminal sanctions. In contrast, Korea still lacks an independent law governing private investigation and remains under an ex post responsibility structure based on general laws such as 「the Act on Punishment of Stalking Crimes」, 「the Protection of Communications Secrets Act」, and 「the Personal Information Protection Act」. On this basis, the study proposes three policy alternatives: a police-supervised licensing model, a quasi-licensing registration model, and a phased introduction model combined with private certification. It argues that a gradual institutionalization strategy would be the most realistic option for Korea.
