ABSTRACT
Development gains capturing system is in the first instance controversy provoking system because of recouping the land value increase in terms of unearned increment in private property ownership regime. Capture issues of land value increment have been ongoing theoretical and ideological disputes because the system's legitimacy is undermined according to the definition of development gains. This article reviews the development related research with categories of economic fundamentals of development gains, capturing system of unearned income based on land value increment, land value tax and gains estimation methods. This study investigates executive issues and judicial judgments of the Supreme Court precedents(95 cases). Analytical categorizations composed of fundamentals of development gain, imposition criteria and development projects, payment agents and unjust enrichment, development gain calculating methods and criteria, land price criteria, exceptional standard not officially appraised land price, development cost recognition, administrative procedure etc.
