ABSTRACT

Operation of Joseon implicative system was based on the law books, however transformation was conducted along with the situation. Particularly, an adopted person was excluded from the implicative system in principle, however implicative rate was applied according to the relationship after adoption. Accordingly, they were completely excluded from implicative system or punished relatively lightly even when they were included. As the case of violation of adoption, this research investigated the descendent of Cheong-eun buwongun and Deokheung daewongun. This was to consider the method to handle in case when the adoptive father or foster parents were implicated with a rebellion. Both cases are in common in respect of being violated with adoption, however there’s a difference that the leading power was different each other. The two families are in the summit of power as the relatives of the royal family, in an indivisible relation with the king, who was an agent of heaven’s will. Adoption of these two families was approved by the king’s special permission. Besides, violation of adoption was available which was possible only by the king’s special permission, since there was no institutional standard less than adoption, since they were near to the authority. Eventually, they utilized their position to the maximum to minimize damage due to the political events and succeed the tradition of their family.
