AB - 공공기여제는 도시관리계획 변경이나 용도지역 변경으로 발생하는 계획이익의 일부를 사회에 환원하기 위한 것으로, 그 운영의 핵심은 감정평가를 통해 토지가치 상승분을 합리적으로 산정하는데 있다. 그러나 현행 공공기여 감정평가는 제도 유형과 지방자치단체별로 평가대상, 평가방법, 수수료 산정기준 등이 상이하여 감정평가 실무에서 혼선과 문제를 초래하고 있다. 이에 본 연구는 중앙정부와 지방자치단체의 공공기여 감정평가 관련 규정과 운영 실체를 비교·분석하고, 실무에서 발생하는 주요 쟁점과 제도적 개선방안을 도출하고자 하였다. 연구결과, 공공기여량 한도 산정을 목적으로 하는 감정평가를 중심으로 평가대상, 평가법인의 선정방식, 공공기여 협의 과정의 형식적인 자문(탁상감정), 수수료 할인 및 미지급 관행 등에 대한 개선방안을 제시하였다.
