AB - 본 연구는 지식재산권 감정평가에서 수익방식의 기본적인 산정구조와 주요 적용방법을 체계적으로 살펴보는 데 목적이 있다. 이를 위해 먼저 지식재산권의 개념과 감정평가 대상 및 주요 고려요소를 살펴보고, 평가대상 권리의 법적·경제적 특성과 시장 및 시장성 분석이 수익방식 적용에서 가지는 의미를 검토하였다. 또한 수익방식 적용의 기초가 되는 현금흐름, 예측기간과 기간 말 가치, 할인율과 위험의 산정구조와 각 요소 간의 관계를 살펴보았다. 이어 지식재산권 감정평가에 활용되는 주요 수익방식인 로열티공제법, 초과이익법, 유무법, 그린필드법 및 배분법의 개념과 산정구조를 검토하고, 사업가치 가운데 평가대상 지식재산권에 귀속되는 경제적 기여를 산정하기 위한 지식재산기여도와 기술요소법의 적용방식을 함께 살펴보았다.
주요 수익방식은 모두 장래 경제적 효익을 현금흐름으로 산정하여 현재가치로 환산한다는 공통점을 가지지만, 현금흐름의 도출 방식, 기여자산의 처리 및 적용에 적합한 지식재산권의 유형에서 차이가 있다. 이러한 차이는 개별 방법이 대상 지식재산권의 경제적 효익을 식별하고 귀속시키는 구조가 서로 다름을 의미한다. 따라서 지식재산권 감정평가에서 수익방식을 적용하기 위해서는 평가대상 권리의 특성과 수익 창출 구조를 파악하고, 이에 적합한 적용방법을 선택하는 한편 현금흐름·예측기간·할인율 등 주요 산정요소 간의 정합성을 확보할 필요가 있다.
