The Government drafted three laws to lay the foundation for the balanced development road maps - the Special Law for Delegating Power to Localities, the Special Law for Balanced National Development and the Special Law for Constructing New Administrative Capital. The Special Law for Balanced National Development to be announced by the Government and to be enforced from April 1. 2004, aims at developing the nation in balanced manner. A balanced, advanced society, in which the nation is united as a harmonious community, is possible only when we remove the structure of contradiction such as privileges, discrimination and exclusion.On the basis of the Law, the Government should revitalize the provincial areas that have lagged so far. It will formulate a special fiscal plan aimed at supporting provincial development. The government offices and many large enterprises, many research institutes that are concentrated in Seoul will be relocated gradually to other areas so that the research infrastructure in provinces. Also the Government should establish a balanced national development plan, and should construct the Regional Innovation System and the balanced national development propulsion system, such as the Presidential Council on Balanced National Development.However, the Law includes some problems to be solved. In this paper, I will discuss these legal issues, such as the extent of the application of the law, the legal system and the jurisdiction on the balanced national development, the selection of lagging behind region, the Presidential Council on Balanced National Development and the special accounts of balanced national development, and then suggest some improvement measures to the issues.
