The Government drafted three laws to lay the foundation for the balanced development road maps - the Special Law for Delegating Power to Localities, the Special Law for Balanced National Development and the Special Law for Constructing New Administrative Capital. The Special Law for Balanced National Development to be announced by the Government and to be enforced from April 1. 2004, aims at developing the nation in balanced manner. A balanced, advanced society, in which the nation is united as a harmonious community, is possible only when we remove the structure of contradiction such as privileges, discrimination and exclusion.On the basis of the Law, the Government should revitalize the provincial areas that have lagged so far. It will formulate a special fiscal plan aimed at supporting provincial development. The government offices and many large enterprises, many research institutes that are concentrated in Seoul will be relocated gradually to other areas so that the research infrastructure in provinces. Also the Government should establish a balanced national development plan, and should construct the Regional Innovation System and the balanced national development propulsion system, such as the Presidential Council on Balanced National Development.However, the Law includes some problems to be solved. In this paper, I will discuss these legal issues, such as the extent of the application of the law, the legal system and the jurisdiction on the balanced national development, the selection of lagging behind region, the Presidential Council on Balanced National Development and the special accounts of balanced national development, and then suggest some improvement measures to the issues.

Es handlet sich bei dieser Abhandlung um die rechtliche und praktische Probleme an der Einrichtung von neuen Verwaltungshauptstadt Koreas, die von der jetzigen koreanischen Regierung durchgefuehrt wird.Anfang dieses Jahres wurde das Gesetz fuer Einrichtung der neuen Verwaltung- shauptstadt Koreas.Aufgrund dieses Gesetzes wurde die Verwaltungskommission aufgebaut und die Untersuchungsphase fuer Auswahl des Standorts der neuen Verwaltungshauptstadt eingegangen.Nach dieses Gesetzes hat die koreanische Regierung sehr starke Macht, um die fuer die Einrichtung deser Stadt benoetigte Boden zu bekommen. Das heisst, dass die Regierung nur durch die Festestzung und Bekanntmachung der die Verwaltungshauptstadt einzurichtende Gebiete in das Enteignungsverfahren eingehen kann.Weiter hin hat die Regierung auch sehr starke Kompetenz fuer Einbindung der Bodennutzung der Buerger, die in dem als neue Verwaltungshauptstadt festgesetzten Gebiet einwohnen sind.Bei dieser Abhandlung wurden einige wichtige rechtliche Probleme der oben genannten Massnahmen der Regierung auseinandergesetzt.

In this study, I analyzed the contents of Special Decentralization Law, the operation system and the problem of local government's plan sovereignty. Then, The Purpose of this study is to study about the alternative of legislation policy for decentralization between central government and local government on the public land law. According to the purpose of legislation, the Scope of the analyzed contents covers the urban planning as the subject of public land law relating to the reinforcement of local autonomy. Under these foregoing issues, I suggest alternative of legislation policy to transfer sovereignty to local government according to the principles and standards of management distribution. The decision of central government make serious infringement on the autonomy of local government, and this ultimately result in the incompetence of local government. The decision which is made by central government should belong to the local government. I think that the optimum urban planning should be handled with the local government under the Basic Land Law and Land Planning Law. In conclusion, the improvement of institutions and the distribution of sovereignty provided in statute by the principles and standards of management distribution ultimately reinforce the legal effects of individual urban planning statutes. The fortifying of the autonomy of urban planning is heavily dependent on the above-mentioned condition.
