A Study on the Systematization of Land Law System

The land system should be supplemented to improve it to the level satisfying its increasing demand and desire. Land laws must conform to the concept of land ownership and progresses to drastically ease the restrictions which are being applied in a uniform manner. In other words priority should be given to the macroscopic land development and its use so that such development or use of land may lead to the creation of a living environment of the residents and a industrial base, that are closely linked to the community in question. The land system should not be regulated indiscriminately on the basis of the uniform standards. Dramatic improvements in the land system need to be made so that it may flexibly conform to the definite features of a particular piece of land. Each law has its own characteristics and peculiarities, and for this reason it is wise to determine the characteristics of each piece of land to devise an appropriate system for that particular piece of land. The current land laws should make a gradual advance towards the systematization. For such systematization the land regulation of various types needs to be linked to one another. Particularly such measures as easing of land ownership as in easing of farmland ownership, centralization of the land licensing system, systematization of the land system's restrictions, and relaxation of the licensing system of the land dealings, need to be implemented. Various laws regulating the land ownership, its development and use should be unified into a single law. Particularly diversified land laws need to be unified and systematized. To achieve such unification of the land laws, the licensing and restriction system of land must be centralized so that any licensing or restrictions may be granted or applied based on a single, unified law. Also such laws regulating the land need to be improved so that they may be applied and implemented democratically. For this, a definite base should be provided in a law so that the provisions of such a law may not be subject to an arbitrary interpretation by an administrative office. Also decisions based on such a law should allow the resident to participate in the decision-making process and encourage the private hands to actively participate in the use of land and its development. At the same time it should encourage a measure designed to actively compensate for the loss incurred as a result of the administrative restriction of land.

Ein Gang durch den erhaltenen Stadtkern einer mittelalterlichen Stadt veranschaulicht, dass der durch die Stadtbefestigung umgrenzte Raum nicht planlos genutzt wurde. Die öffentliche Baurecht umfasst die Gesamtheit der Rechtsvorschriften, die die Zulässigkeit und die Grenzen, die Ordnung und die Förderung der baulichen Nutzung des Bodens, insbesondere durch Errichtung, bestimmungsgemäße Nutung, wesentliche Veränderung und Beseitigung baulicher Anlagen, betreffen. Diese Rechtsmaterie verwirklicht somit das öffentliche Interesse an der Ordnung und Lenkung der Grundstücksnutzung und des Baugeschehens. Im Rahmen des öffentlichen Baurechts läßt sich eine weitere Unterscheidung in Bauplanungs- und Bauordnungsrecht sowie die sonstigen baurechtsrelevanten Vorschriften treffen. Innerhalb der gesamten öffentlichen Baurechts kommt dem Bauplaungsrecht die Aufgabe zu, die rechtlich Qualität des Bodens und seine Nutzbarkeit festzulegen. Bauplaungsrechtliche Normen regeln mithin die Vorbereitung und Leitung der baulichen und sonstigen Nutzung der Grundstücke, insbesondere durch Pläne, welche die Rechtsqualität des Bodens festlegen. Raumordnung ist zusammenfassende, überärtliche und äberfachliche Ordnung des Raum aufgrund von vorgegebenen oder erst zu entwickelnden Leitvorstellungen. Raumordnungsrecht kann als Inbegriff der Rechtsvorschriften bezeichnet werden, die besondere staatliche Träger dazu ermächtigen, den Gesantraum der Republik Korea und seiner Teilräume durch zusammenfassende übergeordnete Raumordnungspläne und durch Abstimmung raumbedeutsamer Planungen und Maßnahmen zu entwickeln, zu ordnen und zu sichern. Die Rechtspolitik für Balanceentwicklung der staatlichen Raum könnte man in Korea in dem Gesetz zur Raumplan von der Renovierung des Hauptstadtssektor sehen. Zur Versteigerung der staatlichen Entwicklungsfähigkeit sollte die Änderung dieses Gesetz notwendig sein.

The Random Questioning in Act on the Performance Duties by Police Officers

The necessity and importance of the use of police authority are growing more and more in highly dangerous society of these days. Moreover, the danger related to the police, unlike in the past, causes significant damages to the benefit and protection of the law in nation and society, individual. Therefore, it needs to keep going concretely and efficiently to the prevention of danger in the police law. In these days, random questioning acts as measures to prevent danger, especially to prevent the crime, most efficiently in the police operation, and takes a front seat by prevention of a crime and predetection and interception of a crime. But regretably, random questioning is one of the compulsory measures used by national authorities and it is regarded as top priority to control and restrain random questioning because of the violation of human rights and fundamental rights protected under constitutional law by abusing it. Therefore, it has been in frequent collision between the police and a nation because random questioning in practical affairs is in between the public power and the human rights. For the public concern over the violation of human rights and the control of the police operation, by imposing the abstract legal requisites and the rigid procedural limits, it is also true that random questioning as measures of the police operation to prevent a crime is not in effect. As a result, it can lead to the higher expense and the lower efficiency in the public security and administration, and weigh with the job performance of the police officers on duty by falling the public power. In case of regarding random questioning in the Act on the Performance of Duties by Police officers as the significant measures, it is no doubtfully important task to study the plan of raising the efficiency of random questioning. Despite the concerns about the violation of the rights caused by abusing act of the police power, but because of sufficient measures done by the control of the court such as accumulation of the precedent and limit theory of the police authorities, it must be done to prevent the benefit and protection of the law in nation and society, individual through the use of the police authorities.

The Status Quo and Its Problem on the Legal System of Public Bond in America

The Federal constitution unequivocally vests power over fiscal matters in the hands of Congress. But the Constitution provides no specific guidance as to how the nation's fiscal policymaking should be conducted. Accordingly, Congress has shaped its own implicit “fiscal constitution” of statutes, internal rules, and legislative and administrative procedures that govern the fiscal policymaking process. One key feature of this fiscal constitution is the debt limit statute(31 USC §§3101∼3130). Congress's authority over policy concerning the national debt stems from Art. I, Section 8, Clauses 1(“to pay the Debt”) and 2(“to borrow Money on the credit of the United States”). On its face, the first imposes a fiscal obligation on Congress while the second confers broad fiscal authority. From these clauses, we can derive three principle of congressional and debt payment(principle of regulated borrowing, principle of borrowing and debt control, principle of repayment). The debt limit statue plays an important role in the fiscal constitution both by helping congress fulfil its constitutional obligations under the borrowing and debt repayment clauses and by ameliorating many of the institutional problems inherent in the legislative process that produce the national budget and fiscal policy. In order to adequately address both the constitutional obligations and the practical criticisms concerning national borrowing suggested reforms to the debt limit statute and debt ceiling increase procedures should proceed from a few basic principles : (1) there should be greater congruence between government borrowing and its purpose, (2) Congress should be accountable to the public for its borrowing decisions and for the size of the national debt, (3) incentives for, and the likehood of, delays in passing debt limit increases that cause the debt ceiling to be breached should be eliminated or at least minimized, and (4) while there is nothing wrong with national debt and some level of debt financing is necessary and even desirable for government for government project.

First, to address the research objectives, the author conducts a thorough literature review to figure out correct meanings of the “constitutional economic order.” Further, the author examines what economy regulation administration in South Korea means and how it has been justified in the country's constitutional order. With the discussion, the author consequently suggests that neutrality is actually a legal obligation applied to government. The neutrality of economy regulation administration is stemmed from the governmental obligation to respect private subjects' freedom and creativity in accordance with section 119 (article 1) of the Constitutional Law. The government also has the constitutional obligation to enforce neutral policies under section 119 (article 2) of the Constitutional Law, which prescribes the duty to prevent abuse of market power and to establish economic democracy through cooperation among economic subjects. As long as the free market system is the foundation of South Korea's economic order, it is impermissible for the government to intervene in market fully and exclusively. Market autonomy is the very core of the free market system. However, ironically, the government has the power to control the economic order available and the governmental intervention is necessary and demanded in oder to embody “diversity,” another rationale of the free market system. That is, it is expected that the government retains the power to protect impartiality of economic order against power concentration of certain private individuals who tend to ignore or compromise benefits of the whole society. Once it is argued that “impartiality” is the ground of the government's intervention in the market, defining “impartiality” clearly is in order. Particularly, concerning the research topic, it should be addressed what it means by holding impartiality in the process of designing policies and their implementation tools for economy regulation administration or whether it is possible that economy regulation administration actually carry out impartiality.
