Nach dem "Gesetz ueber den Ausgleich des uebermaessigen Ertrags durch Wiederbau" wird demjeinigen die sog. Wiederbauabgabe neu erhoben, dem die Ertraege durch Wiederbau der alten Wohnung zugerechnet wird. Im Grunde genommen kann man davon ausgehen, dass die Wiederbauabgabe nach ihren Zweck und Inhalt nicht als Steuer, sondern vielmehr als eine Sonderbgabe zu qualifizieren. Im Hinblick auf die verfassungsrechtlichen Grenzen des Abgabeerfindungsrechts des Gesetzgebers hat jedoch die Wiederbauabgabe die Rechtfertigungsvoraussetzungen zu erfuellen, die einer verfassungsmaessigen Sonderabgabe zu stellen sind, also Gruppenhomogenitaet der Abgabepflichtigen, Gruppennuetzigkeit der Abgabenverwendung, Sachnaehe des Abgabepflichtigen zum Zweck der Abgabeerhebung, Gruppenverantwortung der Abgabepflichtigen zum Abgabenzweck. Die Abgabepflichten der Wiederbauabgabe sind bloss Mitbewohner eines grossen Gebaeudes, so dass sie nicht durch ein gemeinsames kulturellen-, gesellschaftlichen Gefuehel zu charakterisieren sind. Beruecksicht man auf die Verwendung der Abgabeertraege der Wiederbauabgabe, wobei sie meistens auf die allgemeine Wohlfahtr der Stadtbewohner ausgerichtet werden, erfuellt die Wiederbauabgabe die Voraussetzung der Gruppennuetzigkeit nicht. Uebrigens stehen die Abgabepflichtigen der Wiederbauabgabe dem Abgabeverwendungszweck nicht naeher als allgemeine Steuerpflichten. Demzufolge tragen die Abgabepflichtigen keine Gruppenverantwortung fuer den Abgabezweck. Daraus ergibt sich die Schlussfolgerung, dass die Wiederbauabgabe den Gleichheitsgrundsatz nach Art.11 der Koreanischen Verfassung verletzt und deshalb verfassunswidrig ist.

In Korea, there are lots of laws for strictly regulating land use because of narrow land and large population. Among them, we can find a lot of laws without any compensation rules, just causing 'special loss' to the land owners. Nevertheless, the academic circles and judicial precedents haven't established the standards of regulations subject to the right regulations and compensation yet.As for the U.S.A in this study, by the early years of the 20th century the land use regulations based on the police power and the eminent domain were strictly distinguished, and the legal principles of judicial precedents were established: the former aimed at harm-preventing, and the latter at benefit-conferring. However, in the judicial decision of Mahon(Pennsylvania Coal Co., v. Mahon, 260 U.S.393), Justice Holmes declared "Regulations are permitted to a degree, but they can be judged as taking in case they go far, and afterwards, the legal principles which demand the establishment of taking and just compensation in the range of land use regulations. But, in the matter of establishing the test of what land use regulations account for regulatory taking, the Supreme Court is still developing dynamic and refined judicial decision.

In determining the amount of compensation that is just, courts have established the market value of the taken property as the central guide.In fact, the market value of the taken property must be used as the measure of just compensation unless it cannot reasonably be determined or when application of the market value standard would be unjust.Market value employ three principal valuation techniques to establish the price that a willing buyer would be willing to pay for the property.①the price at which comparable properties have been sold (comparable sales approach)②the value of the property based on the discounted present value of the property's projected net income (capitalization approach)③the cost to reproduce or replace the taken property in today's market, unless depreciation (reprodution cost approach)While the court has relied extensively on market value as a working rule to determine the appropriate measure of just compensation, it has also emphasied that market value is not a fetish and that the market value standard may not be the best measure of value in some cases.In addressing the issue of the how much compensation is just over the years, the court has vacillated between a realistic award that is intended to indemnify the former owner fully for the loss suffered, and a less generous award that is intended to limit, as much as resonably possible, the government's obligation to pay.The central difficulty for a practitioner in the area is that the Court has never overruled expressly its inconsistent decisions.Thus, even today, when the Court's most recent decisions seem to prefer the less generous measure of compensation, the more generous standards reflected in some of the Court's earlier decisions remain good law, and may legitimately be applied by a Court, if it should choose to do so.
